Joe Maldonado’s mother is pursuing legal action against a New Jersey Cub Scout pack after her transgender son has been kicked out of the program on gender identity issues. The victim, born Jodie Maldonado told the reporters he has been identifying as a boy for as long as he remembers. He also changed his name legally two years ago and the school recognizes him as a boy.
However, the Cub Scout program says its activities are dedicated to boys only, more precisely individuals who register as boys in their birth certificate.
About a month after Joe successfully got into the program, Pack 87 superintendent informed his mother that her son is no longer recognized as a member, saying that “only boys are allowed”. Moreover, the woman says that when she wanted to offer an explanation, the superintendent rejected her claims, while keeping an arrogant attitude for the entire length of their conversation.
White the Boy Scouts of America lifted bans on gay leaders and scouts alike following years of controversy, spokeswoman Effie Delimarkos says that transgender children are a separate issue. Furthermore, the Boys Scouts officially announced earlier this year that it would admit transgender children to educational programs. However, this does not apply to gender-specific programs like the Cub Scouts.
The executive director of Scouts for Equality, Justin Wilson says that apart from Joe, the Boy Scouts of America did not reject any other applicants over gender identity. At the same time, the Girl Scouts organization has been known to accept transgender members for years. However, the organization is not affiliated with the Boy Scouts.
Reporters could not reach the New Jersey scouting organization for comment on Wednesday, December 28th. Joe Maldonado’s mother says that in light of these events pursuing legal action against the organization is not off the table. She also said that the organization owes her family an apology, at least, and plans to take action in an effort to change the Cub Scout’s policy and “make things right”.
In response, Justin Wilson said he knows at least two more cases of transgender Cub Scout members who are currently part of the program in other regions, one in New York, and the other in a southern state. However, he did not disclose the members’ identity. Ultimately, he said that he was not aware of any instances where the Cub Scouts asked for a birth certificate as a condition for membership.
