On Wednesday, a Manhattan court decided that there is nothing wrong with an NYC bar denying service to a MAGA hat wearer. The judge argued that the laws are not protecting customers against political discrimination.
The plaintiff is a 31-year-old accountant from Philadelphia who was denied service and thrown out of The Happiest Hour bar in West Village for wearing a ‘Make America Great Again’ cap, days after Trump was sworn in.
Greg Piatek sued the bar, claiming that he was discriminated against. He claims that the bar’s employees told him to “leave right now” because Trump supporters or people sharing his views “[are] not welcomed here.”
The man was asked to leave after he and his friends complained about one of the bartenders’ poor service.
Piatek filed a lawsuit against the bar in Manhattan Supreme Court, telling the judge that the way he was treated “offended [his] sense of being American.”
However, this week, the judge sided with the bar’s lawyer which noted that the city and state laws only protect people against religious discrimination, not the political one. The defense slammed Piatek for turning his support of Trump into a religion.
Judge Unimpressed by Plaintiff’s Reasoning
Piatek’s lawyer explained that the man was wearing the MAGA hat because he had just returned from the 9/11 Memorial and wanted to pay spiritual tribute to those killed in the 9/11 attacks.
The Make American Great Again hat was part of his spiritual belief,
the lawyer added.
The man refused to remove his hat in the bar because he wanted to hold true to his spiritual belief, according to the lawyer.
The judge dismissed the reasoning, mocking the plaintiff’s unusual religious beliefs. He asked Piatek’s lawyer how many people were sharing his client’s professed creed. When the lawyer couldn’t mention other people’s names, the judge concluded that it must be “a creed of one” and dismissed the case.
